Regulamin sklepu sprzedaży Raportu SGH i Forum Ekonomicznego
REGULAMIN SKLEPU SPRZEDAŻY RAPORTU SGH I FORUM EKONOMICZNEGO
§ 1. Postanowienia wstępne
1. Sklep internetowy dostępny pod adresem internetowym https://raportsghforum.pl.
2. Niniejszy Regulamin jest skierowany do Konsumentów, Przedsiębiorców oraz Przedsiębiorców na prawach konsumenta korzystających ze Sklepu i określa zasady korzystania ze Sklepu, składania Zamówień, zawierania i wykonywania Umów Sprzedaży na odległość, dostawy Produktów, dostarczania treści cyfrowych oraz usług cyfrowych, odstąpienia od umowy, zwrotów i reklamacji.
3. Regulamin stanowi także regulamin świadczenia usług drogą elektroniczną w rozumieniu art. 8 ustawy z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną w zakresie usług świadczonych za pośrednictwem Sklepu, w szczególności umożliwienia przeglądania asortymentu, składania Zamówień, prowadzenia Konta oraz komunikacji drogą elektroniczną.
4. Regulamin uwzględnia w szczególności przepisy: ustawy z dnia 30 maja 2014 r. o prawach konsumenta, Kodeksu cywilnego, ustawy z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną, rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 (RODO), ustawy z dnia 23 września 2016 r. o pozasądowym rozwiązywaniu sporów konsumenckich oraz rozporządzenia Parlamentu Europejskiego i Rady (UE) 2024/3228 uchylającego rozporządzenie (UE) nr 524/2013 w sprawie platformy ODR.
Podstawa prawna: art. 8 ust. 1 ustawy o świadczeniu usług drogą elektroniczną; art. 12, art. 17, art. 21, art. 27-38 oraz art. 43a-43q ustawy o prawach konsumenta; art. 548 § 3 Kodeksu cywilnego; art. 28 RODO; rozporządzenie (UE) 2024/3228.
§ 2. Definicje
1. Konsument - osoba fizyczna zawierająca ze Sprzedawcą umowę za pośrednictwem Sklepu, której przedmiot nie jest związany bezpośrednio z jej działalnością gospodarczą lub zawodową.
2. Przedsiębiorca na prawach konsumenta - osoba fizyczna zawierająca ze Sprzedawcą umowę bezpośrednio związaną z jej działalnością gospodarczą, gdy z treści tej umowy wynika, że nie posiada ona dla tej osoby charakteru zawodowego, wynikającego w szczególności z przedmiotu wykonywanej przez nią działalności gospodarczej ujawnionego w CEIDG. Postanowienia Regulaminu dotyczące Konsumenta stosuje się do takiej osoby w zakresie wynikającym z powszechnie obowiązujących przepisów prawa.
3. Sprzedawca - Fundacja Instytut Studiów Wschodnich z siedzibą w Warszawie, ul. Solec 85, 00-382 Warszawa, NIP 521-10-01-909, wpisana do Rejestru Stowarzyszeń, Innych Organizacji Społecznych, Zawodowych, Fundacji oraz Samodzielnych Publicznych Zakładów Opieki Zdrowotnej prowadzonego przez Sąd Rejonowy dla m.st. Warszawy w Warszawie, XII Wydział Gospodarczy KRS, pod numerem KRS 0000010303.
4. Klient - każdy podmiot dokonujący zakupów za pośrednictwem Sklepu albo korzystający ze Sklepu.
5. Przedsiębiorca - osoba fizyczna, osoba prawna albo jednostka organizacyjna niebędąca osobą prawną, której ustawa przyznaje zdolność prawną, wykonująca we własnym imieniu działalność gospodarczą lub zawodową i korzystająca ze Sklepu.
6. Sklep - sklep internetowy prowadzony przez Sprzedawcę pod adresem https://raportsghforum.pl.
7. Regulamin - niniejszy regulamin Sklepu.
8. Zamówienie - oświadczenie woli Klienta składane za pomocą Formularza zamówienia i zmierzające bezpośrednio do zawarcia Umowy Sprzedaży Produktu albo Produktów ze Sprzedawcą.
9. Konto - konto Klienta w Sklepie, w którym gromadzone są dane podane przez Klienta oraz informacje o złożonych Zamówieniach, o ile Sklep przewiduje funkcjonalność Konta.
10. Formularz zamówienia - interaktywny formularz dostępny w Sklepie umożliwiający złożenie Zamówienia, w szczególności poprzez dodanie Produktów do Koszyka, podanie danych niezbędnych do wykonania umowy oraz wybór sposobu dostawy i płatności.
11. Koszyk - element oprogramowania Sklepu, w którym widoczne są wybrane przez Klienta Produkty, cena, koszty dostawy oraz dane Zamówienia możliwe do modyfikacji przed jego złożeniem.
12. Produkt - towar, treść cyfrowa, usługa cyfrowa albo inna usługa dostępna w Sklepie, będąca przedmiotem Umowy Sprzedaży między Klientem a Sprzedawcą.
13. Raport papierowy - Produkt będący rzeczą ruchomą w postaci drukowanego raportu, dostarczany Klientowi przesyłką kurierską, do paczkomatu lub inną metodą wskazaną w Sklepie.
14. Produkt przedpremierowy - Produkt oferowany w Sklepie przed datą jego oficjalnej premiery, prezentacji, publikacji albo udostępnienia, w szczególności Raport papierowy oferowany w przedsprzedaży przed jego oficjalną prezentacją. Produkt przedpremierowy jest wysyłany albo udostępniany w terminie wskazanym w opisie Produktu, w Koszyku lub w podsumowaniu Zamówienia przed złożeniem Zamówienia.
15. Treść cyfrowa - dane wytwarzane i dostarczane w postaci cyfrowej, w szczególności raport w formacie PDF, nagranie webinaru, prezentacja, plik, link do pobrania lub inny materiał elektroniczny, który nie jest dostarczany na nośniku materialnym.
16. Usługa cyfrowa - usługa pozwalająca Klientowi na wytwarzanie, przetwarzanie, przechowywanie danych lub dostęp do danych w postaci cyfrowej albo wspólne korzystanie z danych w postaci cyfrowej, jeżeli jest oferowana przez Sprzedawcę w ramach Sklepu.
17. Webinar - usługa świadczona drogą elektroniczną, polegająca na udostępnieniu Klientowi udziału w spotkaniu, szkoleniu, transmisji online lub dostępu do nagrania, zgodnie z opisem Produktu.
18. Umowa Sprzedaży - umowa zawierana albo zawarta między Klientem a Sprzedawcą za pośrednictwem Sklepu. W zależności od rodzaju Produktu przez Umowę Sprzedaży rozumie się również umowę o dostarczanie treści cyfrowych, umowę o świadczenie usługi cyfrowej albo umowę o świadczenie usług.
19. Podwykonawca logistyczny - osoba lub podmiot zewnętrzny działający na zlecenie Sprzedawcy, wykonujący czynności techniczne związane z przygotowaniem Raportu papierowego do wysyłki, pakowaniem, nadawaniem przesyłek lub obsługą zwrotów. Korzystanie z Podwykonawcy logistycznego nie ogranicza odpowiedzialności Sprzedawcy wobec Klienta.
20. Dzień roboczy - dzień od poniedziałku do piątku, z wyłączeniem dni ustawowo wolnych od pracy w Polsce.
21. Trwały nośnik - materiał lub narzędzie umożliwiające Klientowi przechowywanie informacji kierowanych osobiście do niego w sposób umożliwiający dostęp do informacji w przyszłości przez czas odpowiedni do celów, jakim informacje te służą, i pozwalające na odtworzenie przechowywanych informacji w niezmienionej postaci; przykładem trwałego nośnika jest wiadomość e-mail.
Podstawa prawna: art. 2 pkt 4, art. 2 pkt 5a i art. 2 pkt 5b ustawy o prawach konsumenta; art. 43h ustawy o prawach konsumenta; art. 385(5) Kodeksu cywilnego oraz przepisy rozszerzające ochronę konsumencką na określonych przedsiębiorców-osoby fizyczne.
§ 3. Kontakt ze Sklepem
1. Adres e-mail Sprzedawcy: wspolpraca@isw.org.pl.
2. Adres korespondencyjny Sprzedawcy: Fundacja Instytut Studiów Wschodnich, ul. Solec 85, 00-382 Warszawa.
3. Klient może porozumiewać się ze Sprzedawcą przy wykorzystaniu adresu e-mail albo adresu korespondencyjnego wskazanego w niniejszym paragrafie.
4. Sprzedawca może kontaktować się z Klientem na adres e-mail podany przez Klienta podczas składania Zamówienia, w szczególności w celu potwierdzenia Zamówienia, dostarczenia Treści cyfrowych, przekazania linku do Webinaru, obsługi reklamacji, obsługi odstąpienia od umowy lub realizacji zwrotu.
§ 4. Wymagania techniczne
1. Do korzystania ze Sklepu, w tym przeglądania asortymentu i składania Zamówień, niezbędne są:
a) urządzenie końcowe z dostępem do sieci Internet;
b) aktualna przeglądarka internetowa obsługująca standardowe strony www, np. Chrome, Firefox, Edge, Safari albo Opera;
c) aktywne konto poczty elektronicznej e-mail;
d) włączona obsługa plików cookies w zakresie niezbędnym do działania Sklepu;
e) możliwość odczytywania wiadomości e-mail oraz otwierania załączników lub linków przesyłanych przez Sprzedawcę.
2. Do korzystania z Treści cyfrowych lub Webinarów mogą być wymagane dodatkowo:
a) program umożliwiający odczyt plików PDF, jeżeli Produkt obejmuje materiały w formacie PDF;
b) przeglądarka internetowa albo aplikacja wskazana w opisie Produktu lub w wiadomości e-mail z dostępem;
c) stabilne połączenie internetowe umożliwiające udział w Webinarze albo pobranie materiałów;
d) urządzenie umożliwiające odtwarzanie dźwięku i obrazu, jeżeli Produkt obejmuje nagranie albo transmisję audiowizualną.
3. Sprzedawca informuje Klienta w opisie Produktu albo przed zawarciem Umowy Sprzedaży o istotnych funkcjonalnościach, kompatybilności i interoperacyjności Treści cyfrowych, Usług cyfrowych lub Webinarów, o których Sprzedawca wie albo powinien wiedzieć.
4. Klient powinien podać prawidłowy adres e-mail oraz zapewnić możliwość odbierania wiadomości od Sprzedawcy, w tym sprawdzić folder SPAM, oferty, inne lub podobny folder, jeżeli wiadomość z potwierdzeniem Zamówienia, Treścią cyfrową albo linkiem do Webinaru nie dotarła do głównej skrzynki odbiorczej.
Podstawa prawna: art. 8 ust. 3 ustawy o świadczeniu usług drogą elektroniczną; art. 12 ust. 1 pkt 19-20 ustawy o prawach konsumenta.
§ 5. Informacje ogólne
1. Sprzedawca prowadzi sprzedaż Produktów za pośrednictwem Sklepu, w szczególności Raportu papierowego, Treści cyfrowych oraz Webinarów.
2. Sprzedawca może oferować w Sklepie Produkty przedpremierowe, w tym Raport papierowy w przedsprzedaży. W takim przypadku informacja o przedpremierowym charakterze Produktu, dacie premiery, prezentacji, publikacji albo udostępnienia oraz przewidywanym terminie wysyłki albo dostarczenia Produktu jest wskazywana w opisie Produktu lub w toku składania Zamówienia przed zawarciem Umowy Sprzedaży.
3. Przeglądanie asortymentu Sklepu nie wymaga zakładania Konta. Składanie Zamówień możliwe jest po podaniu danych niezbędnych do realizacji Zamówienia, w szczególności danych identyfikacyjnych, danych kontaktowych, adresu e-mail, a w przypadku Raportu papierowego również danych adresowych niezbędnych do dostawy.
4. Ceny podane w Sklepie są wyrażone w złotych polskich i stanowią ceny całkowite należne od Klienta, obejmujące podatki, jeżeli zgodnie z przepisami są one należne. Przed złożeniem Zamówienia Klient otrzymuje informację o łącznej kwocie do zapłaty, obejmującej cenę Produktu oraz koszty dostawy, płatności lub inne koszty, jeżeli występują.
5. Na końcową kwotę do zapłaty składa się cena Produktu oraz koszt dostawy Raportu papierowego lub inne koszty wskazane Klientowi przed złożeniem Zamówienia. Jeżeli Produkt jest dostarczany wyłącznie drogą elektroniczną, koszt fizycznej dostawy nie jest naliczany, chyba że wyraźnie wskazano inaczej.
6. Jeżeli charakter Produktu nie pozwala, rozsądnie oceniając, na wcześniejsze obliczenie ceny albo kosztów dodatkowych, Sprzedawca informuje Klienta przed złożeniem Zamówienia o sposobie obliczenia ceny lub kosztów.
7. Sprzedawca nie stosuje wobec Konsumenta domyślnie zaznaczonych opcji powodujących dodatkowe płatności. Dodatkowe płatności wymagają wyraźnej zgody Klienta wyrażonej przed złożeniem Zamówienia.
8. Sprzedawca w najszerszym dopuszczalnym przez prawo zakresie nie ponosi odpowiedzialności za zakłócenia w funkcjonowaniu Sklepu spowodowane siłą wyższą, niedozwolonym działaniem osób trzecich albo niekompatybilnością infrastruktury technicznej Klienta z wymaganiami technicznymi wskazanymi w Regulaminie. Postanowienie to nie ogranicza ustawowych praw Konsumenta oraz Przedsiębiorcy na prawach konsumenta.
Podstawa prawna: art. 12 ust. 1 pkt 5, 6, 10, 19 i 20, art. 17 oraz art. 18 ustawy o prawach konsumenta.
§ 6. Zasady składania Zamówienia
1. W celu złożenia Zamówienia należy:
a) wybrać Produkt będący przedmiotem Zamówienia i dodać go do Koszyka;
b) wypełnić Formularz zamówienia, podając dane niezbędne do wykonania Umowy Sprzedaży, w szczególności adres e-mail, dane do płatności, dane do faktury, jeżeli faktura jest wymagana, oraz adres dostawy w przypadku Raportu papierowego;
c) wybrać jeden z dostępnych sposobów dostawy Raportu papierowego, jeżeli Zamówienie obejmuje Produkt wymagający fizycznej dostawy;
d) zapoznać się z podsumowaniem Zamówienia, w tym całkowitą ceną, kosztami dostawy oraz warunkami dostarczenia Produktów, a w przypadku Produktu przedpremierowego także z informacją o tym, że Produkt jest oferowany w przedsprzedaży, nie zostanie wysłany albo udostępniony przed wskazaną datą premiery, prezentacji, publikacji albo udostępnienia oraz zostanie wysłany albo udostępniony w terminie wskazanym w opisie Produktu, Koszyku lub podsumowaniu Zamówienia;
e) w przypadku Treści cyfrowych albo Webinarów, które mają zostać dostarczone lub rozpoczęte przed upływem terminu do odstąpienia od umowy, złożyć odrębne wymagane prawem oświadczenia i zgody, o których mowa w § 9 Regulaminu;
f) kliknąć przycisk „Zamawiam i płacę” albo inny równoważny przycisk jednoznacznie wskazujący, że Zamówienie pociąga za sobą obowiązek zapłaty;
g) wybrać jedną z dostępnych metod płatności i opłacić Zamówienie.
2. Do momentu kliknięcia przycisku „Zamawiam i płacę” Klient może modyfikować dane Zamówienia oraz wybrane Produkty w Koszyku.
3. Kliknięcie przycisku „Zamawiam i płacę” oznacza złożenie przez Klienta Zamówienia z obowiązkiem zapłaty.
Podstawa prawna: art. 17 ust. 2-4 ustawy o prawach konsumenta.
§ 7. Oferowane metody dostawy oraz płatności
1. Klient może skorzystać z następujących metod dostawy Raportu papierowego, o ile są one aktualnie dostępne w Sklepie:
a) przesyłka kurierska i Paczkomaty InPost;
b) przesyłka kurierska DPD;
d) inna metoda dostawy wyraźnie wskazana w Sklepie przed złożeniem Zamówienia – jeżeli występuje.
2. Treści cyfrowe, linki do pobrania, materiały elektroniczne, linki dostępowe do Webinarów albo informacje organizacyjne dotyczące Webinarów są dostarczane na adres e-mail podany przez Klienta w Zamówieniu, chyba że opis Produktu wyraźnie przewiduje inny sposób dostarczenia.
3. Szczegółowe informacje o dostępnych metodach dostawy, kosztach dostawy, przewidywanym terminie wysyłki lub dostarczenia Produktu są wskazywane w Sklepie najpóźniej przed złożeniem Zamówienia. W przypadku Produktów przedpremierowych termin wysyłki lub dostarczenia może przypadać po dacie premiery, prezentacji, publikacji albo udostępnienia Produktu, o czym Klient jest informowany przed złożeniem Zamówienia.
4. Sprzedawca może korzystać z usług Podwykonawcy logistycznego przy przygotowaniu Raportu papierowego do wysyłki, pakowaniu, nadawaniu przesyłek i obsłudze zwrotów. Korzystanie z Podwykonawcy logistycznego nie ogranicza odpowiedzialności Sprzedawcy wobec Klienta za należyte wykonanie Umowy Sprzedaży, w tym za wydanie Produktu, dostarczenie Produktu, rozpatrywanie reklamacji oraz obsługę odstąpienia od umowy.
5. Podmiotem świadczącym obsługę płatności online są Przelewy24, w szczególności w zakresie płatności elektronicznych, przelewów elektronicznych, BLIK oraz płatności kartą płatniczą: Visa, Visa Electron, MasterCard, MasterCard Electronic i Maestro, o ile dana metoda płatności jest dostępna w Sklepie w chwili składania Zamówienia.
6. Szczegółowe informacje o akceptowanych metodach płatności są dostępne na stronach Sklepu i widoczne dla Klienta przed złożeniem Zamówienia.
Podstawa prawna: art. 12 ust. 1 pkt 5, 9 i 10 ustawy o prawach konsumenta; art. 548 § 3 Kodeksu cywilnego.
§ 8. Wykonanie Umowy Sprzedaży
1. Zawarcie Umowy Sprzedaży między Klientem a Sprzedawcą następuje po złożeniu Zamówienia za pomocą Formularza zamówienia, zgodnie z § 6 Regulaminu, oraz po potwierdzeniu przyjęcia Zamówienia przez Sprzedawcę.
2. Po złożeniu Zamówienia Sprzedawca niezwłocznie potwierdza otrzymanie Zamówienia i jego przyjęcie do realizacji poprzez przesłanie Klientowi wiadomości e-mail na adres podany podczas składania Zamówienia. Wiadomość e-mail stanowi potwierdzenie zawarcia Umowy Sprzedaży na trwałym nośniku.
3. Potwierdzenie, o którym mowa w ust. 2, obejmuje co najmniej informacje o Sprzedawcy, Produkcie, cenie, kosztach dostawy, sposobie płatności, sposobie i terminie dostarczenia Produktu, a w przypadku Produktu przedpremierowego również informację o przedpremierowym charakterze Produktu oraz terminie jego wysyłki albo udostępnienia, pouczeniu o prawie odstąpienia od umowy albo o jego braku, procedurze reklamacyjnej oraz treści Regulaminu lub dostępie do jego treści w formie możliwej do utrwalenia.
4. W przypadku Treści cyfrowych albo Webinarów dostarczanych lub rozpoczynanych przed upływem terminu do odstąpienia od umowy Sprzedawca potwierdza Klientowi na trwałym nośniku również zgodę Klienta na rozpoczęcie dostarczania Treści cyfrowych albo wykonania usługi przed upływem terminu do odstąpienia oraz potwierdzenie przyjęcia przez Klienta do wiadomości skutków tej zgody.
5. W przypadku płatności elektronicznych albo płatności kartą płatniczą Klient jest obowiązany do dokonania płatności w terminie 2 dni kalendarzowych od dnia złożenia Zamówienia, chyba że opis Produktu albo komunikat operatora płatności wskazuje inny termin. Brak płatności w tym terminie może skutkować anulowaniem Zamówienia.
6. Raport papierowy zostanie wysłany w terminie wskazanym w opisie Produktu lub w podsumowaniu Zamówienia, a jeżeli takiego terminu nie wskazano - nie później niż w terminie 30 dni od dnia zawarcia Umowy Sprzedaży, z zastrzeżeniem ust. 7.
7. Raporty papierowe mogą być przygotowywane i nadawane w partiach. Jeżeli Sprzedawca stosuje wysyłkę w partiach, informacja o terminie wysyłki lub zasadach wysyłki w partiach jest podawana Klientowi w opisie Produktu albo w toku składania Zamówienia, przed kliknięciem przycisku „Zamawiam i płacę”.
8. W przypadku Produktów przedpremierowych, w tym Raportu papierowego oferowanego w przedsprzedaży, termin wysyłki albo dostarczenia Produktu może być późniejszy niż 30 dni od dnia zawarcia Umowy Sprzedaży, jeżeli taki późniejszy termin został wyraźnie wskazany Klientowi przed złożeniem Zamówienia, w szczególności w opisie Produktu, Koszyku, podsumowaniu Zamówienia lub potwierdzeniu Zamówienia.
9. Raport papierowy, którego oficjalna prezentacja nastąpi w dniu 8 września 2026 r., jest Produktem przedpremierowym. Wysyłka tego Raportu papierowego nastąpi nie wcześniej niż po dniu 8 września 2026 r.
10. Raport papierowy, o którym mowa w ust. §2 ust. 13, zostanie nadany do wysyłki w terminie do 5 dni roboczych od dnia 8 września 2026 r., chyba że w opisie Produktu lub podsumowaniu Zamówienia wskazano inny termin. Zamówienia mogą być realizowane w partiach, zgodnie z kolejnością złożenia i opłacenia Zamówień albo zgodnie z innymi zasadami wskazanymi Klientowi przed złożeniem Zamówienia.
8. Dostawa Raportu papierowego odbywa się wyłącznie na terenie Polski, chyba że w opisie Produktu lub w Sklepie wyraźnie wskazano inaczej.
9. Niebezpieczeństwo przypadkowej utraty lub uszkodzenia Raportu papierowego przechodzi na Konsumenta z chwilą jego wydania Konsumentowi albo wskazanej przez niego osobie trzeciej innej niż przewoźnik. Jeżeli Konsument sam wybrał przewoźnika, którego Sprzedawca nie oferował w Sklepie, niebezpieczeństwo przechodzi na Konsumenta z chwilą wydania Produktu temu przewoźnikowi.
10. Treści cyfrowe i materiały elektroniczne są dostarczane poprzez przesłanie wiadomości e-mail zawierającej plik, link do pobrania, instrukcję dostępu albo inne informacje umożliwiające skorzystanie z Produktu. Termin dostarczenia Treści cyfrowej jest wskazany w opisie Produktu, podsumowaniu Zamówienia albo wiadomości e-mail, a w braku takiej informacji Treść cyfrowa jest dostarczana niezwłocznie po uzyskaniu pozytywnej autoryzacji płatności, jeżeli Klient wyraził zgodę na jej dostarczenie przed upływem terminu do odstąpienia od umowy.
11. Link do Webinaru live albo informacje organizacyjne dotyczące Webinaru są wysyłane na adres e-mail Klienta w terminie wskazanym w opisie Produktu albo w wiadomości potwierdzającej Zamówienie, najpóźniej przed rozpoczęciem Webinaru, chyba że opis Produktu stanowi inaczej.
12. Jeżeli Zamówienie obejmuje jednocześnie Raport papierowy oraz Treści cyfrowe lub Webinar, poszczególne świadczenia mogą być wykonane niezależnie od siebie, odpowiednio przez fizyczną dostawę Raportu papierowego oraz wysyłkę materiałów lub linków na adres e-mail.
13. W przypadku nieotrzymania wiadomości e-mail z Treścią cyfrową, linkiem do pobrania albo linkiem do Webinaru Klient powinien sprawdzić folder SPAM, oferty, inne lub podobny folder, a następnie skontaktować się ze Sprzedawcą. Sprzedawca zweryfikuje status Zamówienia i, jeżeli będzie to uzasadnione, ponownie wyśle wiadomość albo zapewni inny uzgodniony sposób dostępu.
Podstawa prawna: art. 21 ustawy o prawach konsumenta; art. 543(1) i art. 548 § 3 Kodeksu cywilnego; art. 43k-43m ustawy o prawach konsumenta w zakresie dostarczania treści cyfrowych lub usług cyfrowych.
§ 9. Prawo odstąpienia od umowy i zwroty
1. Konsument oraz Przedsiębiorca na prawach konsumenta mogą co do zasady w terminie 14 dni odstąpić od Umowy Sprzedaży zawartej na odległość bez podania przyczyny, z zastrzeżeniem wyjątków wskazanych w Regulaminie i przepisach prawa.
2. Bieg terminu do odstąpienia od umowy rozpoczyna się:
a) dla Raportu papierowego - od objęcia Raportu papierowego w posiadanie przez Konsumenta albo wskazaną przez niego osobę trzecią inną niż przewoźnik;
b) dla Umowy obejmującej wiele rzeczy dostarczanych osobno, partiami lub w częściach - od objęcia w posiadanie ostatniej rzeczy, partii lub części;
c) dla Umowy polegającej na regularnym dostarczaniu rzeczy przez czas oznaczony - od objęcia w posiadanie pierwszej rzeczy;
d) dla umów o świadczenie usług, w tym Webinarów, oraz dla umów o dostarczanie Treści cyfrowych lub Usług cyfrowych niedostarczanych na nośniku materialnym - od dnia zawarcia umowy.
3. W przypadku Raportu papierowego oferowanego w przedsprzedaży albo jako Produkt przedpremierowy, termin do odstąpienia od umowy liczony jest zgodnie z ust. 2 lit. a, tj. od objęcia Raportu papierowego w posiadanie przez Konsumenta albo wskazaną przez niego osobę trzecią inną niż przewoźnik, niezależnie od dnia złożenia Zamówienia lub dnia dokonania płatności.
4. Konsument może odstąpić od Umowy Sprzedaży, składając Sprzedawcy oświadczenie o odstąpieniu od umowy. Do zachowania terminu wystarczy wysłanie oświadczenia przed jego upływem.
5. Oświadczenie może zostać wysłane pocztą tradycyjną na adres Sprzedawcy albo drogą elektroniczną na adres e-mail wskazany w § 3 Regulaminu. Konsument może skorzystać z ustawowego wzoru formularza odstąpienia, stanowiącego Załącznik nr 1 do Regulaminu, jednak nie jest to obowiązkowe, lub skorzystać z formularza odstąpienia od umowy dostępnego na bezpośrednio na stronie.
6. W przypadku otrzymania oświadczenia o odstąpieniu drogą elektroniczną Sprzedawca niezwłocznie potwierdzi Konsumentowi otrzymanie oświadczenia na adres e-mail Konsumenta.
7. W przypadku odstąpienia od Umowy Sprzedaży umowę uważa się za niezawartą, a Sprzedawca zwraca Konsumentowi wszystkie otrzymane od niego płatności, w tym koszty dostarczenia Raportu papierowego do Konsumenta, z wyjątkiem dodatkowych kosztów wynikających z wybranego przez Konsumenta sposobu dostarczenia innego niż najtańszy zwykły sposób dostarczenia oferowany przez Sprzedawcę.
8. Konsument może złożyć oświadczenie o odstąpieniu od umowy dotyczącej Raportu papierowego oferowanego w przedsprzedaży również przed jego wysyłką. W takim przypadku Sprzedawca zwraca płatności zgodnie z Regulaminem i przepisami prawa, bez oczekiwania na odesłanie Produktu, który nie został jeszcze wysłany Konsumentowi.
9. Zwrot płatności następuje niezwłocznie, nie później niż w terminie 14 dni od dnia otrzymania przez Sprzedawcę oświadczenia o odstąpieniu od umowy, przy użyciu takiego samego sposobu zapłaty, jakiego użył Konsument, chyba że Konsument wyraźnie zgodził się na inny sposób zwrotu, który nie wiąże się dla niego z żadnymi kosztami.
10. Jeżeli Zamówienie obejmowało Raport papierowy, Sprzedawca może wstrzymać się ze zwrotem płatności do czasu otrzymania Raportu papierowego z powrotem albo do czasu dostarczenia Sprzedawcy dowodu jego odesłania, w zależności od tego, które zdarzenie nastąpi wcześniej.
11. Konsument powinien odesłać Raport papierowy na adres: Fundacja Instytut Studiów Wschodnich, ul. Solec 85, 00-382 Warszawa, niezwłocznie, nie później niż w terminie 14 dni od dnia, w którym poinformował Sprzedawcę o odstąpieniu od umowy. Termin jest zachowany, jeżeli Konsument odeśle Raport papierowy przed upływem terminu 14 dni.
12. Konsument ponosi bezpośrednie koszty zwrotu Raportu papierowego, chyba że Sprzedawca zgodził się je ponieść albo nie poinformował Konsumenta przed zawarciem umowy o konieczności poniesienia tych kosztów.
13. Konsument odpowiada za zmniejszenie wartości Raportu papierowego wynikające z korzystania z niego w sposób inny niż konieczny do stwierdzenia charakteru, cech i funkcjonowania Produktu.
14. Jeżeli Konsument zażądał rozpoczęcia świadczenia usługi, w tym Webinaru, przed upływem terminu do odstąpienia od umowy, a następnie wykonuje prawo odstąpienia przed pełnym wykonaniem usługi, Konsument jest obowiązany do zapłaty za świadczenia spełnione do chwili odstąpienia od umowy proporcjonalnie do zakresu spełnionego świadczenia, o ile taki obowiązek wynika z przepisów prawa i Sprzedawca prawidłowo poinformował Konsumenta o skutkach rozpoczęcia świadczenia.
15. Prawo odstąpienia od umowy nie przysługuje Konsumentowi w szczególności w odniesieniu do umowy:
a) o świadczenie usług, za które Konsument jest zobowiązany do zapłaty ceny, jeżeli Sprzedawca wykonał w pełni usługę za wyraźną i uprzednią zgodą Konsumenta, który został poinformowany przed rozpoczęciem świadczenia, że po spełnieniu świadczenia przez Sprzedawcę utraci prawo odstąpienia od umowy, i przyjął to do wiadomości;
b) o dostarczanie Treści cyfrowych niedostarczanych na nośniku materialnym, za które Konsument jest zobowiązany do zapłaty ceny, jeżeli Sprzedawca rozpoczął świadczenie za wyraźną i uprzednią zgodą Konsumenta, Konsument został poinformowany przed rozpoczęciem świadczenia, że po rozpoczęciu świadczenia utraci prawo odstąpienia od umowy, przyjął to do wiadomości, a Sprzedawca przekazał Konsumentowi potwierdzenie zawarcia umowy oraz potwierdzenie udzielonej zgody na trwałym nośniku;
c) w której przedmiotem świadczenia jest rzecz nieprefabrykowana, wyprodukowana według specyfikacji Konsumenta albo służąca zaspokojeniu jego zindywidualizowanych potrzeb;
d) w której przedmiotem świadczenia są rzeczy, które po dostarczeniu, ze względu na swój charakter, zostają nierozłącznie połączone z innymi rzeczami;
e) w innych przypadkach wskazanych w art. 38 ustawy o prawach konsumenta, jeżeli mają zastosowanie do konkretnego Produktu.
16. W przypadku Treści cyfrowych lub Webinarów wysyłanych na adres e-mail Sprzedawca stosuje odrębne zgody i potwierdzenia w Formularzu zamówienia, jeżeli dostarczenie Treści cyfrowych albo rozpoczęcie świadczenia usługi ma nastąpić przed upływem 14 dni od zawarcia umowy.
17. Samo wskazanie w Regulaminie, że dany Produkt ma charakter cyfrowy, nie powoduje automatycznej utraty prawa odstąpienia od umowy. Utrata prawa odstąpienia w odniesieniu do Treści cyfrowych albo usług świadczonych przed upływem terminu do odstąpienia wymaga spełnienia warunków wskazanych w ustawie o prawach konsumenta.
Podstawa prawna: art. 27-35 oraz art. 38 ustawy o prawach konsumenta; art. 21 ustawy o prawach konsumenta w zakresie potwierdzenia zgody na trwałym nośniku.
§ 10. Reklamacje, niezgodność towaru z umową oraz gwarancja
1. Sprzedawca jest zobowiązany dostarczyć Produkt zgodny z Umową Sprzedaży.
2. Wobec Konsumenta oraz Przedsiębiorcy na prawach konsumenta odpowiedzialność Sprzedawcy za Raport papierowy jest określona przepisami ustawy o prawach konsumenta dotyczącymi niezgodności towaru z umową, w szczególności art. 43a-43g tej ustawy.
3. Wobec Konsumenta oraz Przedsiębiorcy na prawach konsumenta odpowiedzialność Sprzedawcy za Treści cyfrowe, Usługi cyfrowe i Webinary jest określona przepisami ustawy o prawach konsumenta dotyczącymi treści cyfrowych i usług cyfrowych, w szczególności art. 43h-43q tej ustawy, z uwzględnieniem rodzaju danego świadczenia.
4. Reklamacja może dotyczyć w szczególności:
a) uszkodzenia, braku kompletności, opóźnienia, niedostarczenia albo niezgodności Raportu papierowego z opisem Produktu;
b) braku otrzymania wiadomości e-mail z Treścią cyfrową, linkiem do pobrania, linkiem do Webinaru albo instrukcją dostępu;
c) nieaktywnego, błędnego albo niedziałającego linku;
d) pliku, którego nie da się otworzyć mimo spełnienia wymagań technicznych;
e) braku dostępu do Webinaru mimo prawidłowo opłaconego Zamówienia i spełnienia wymagań technicznych;
f) dostarczenia innych materiałów niż wskazane w opisie Produktu;
g) innej niezgodności Produktu z Umową Sprzedaży.
5. Reklamację można złożyć pisemnie na adres Sprzedawcy albo drogą elektroniczną na adres e-mail wskazany w § 3 Regulaminu.
6. Zaleca się, aby reklamacja zawierała dane Klienta, numer Zamówienia, opis niezgodności, datę jej stwierdzenia, żądanie Klienta oraz dane kontaktowe umożliwiające udzielenie odpowiedzi. Brak tych elementów nie powoduje bezskuteczności reklamacji, jeżeli możliwe jest jej rozpatrzenie na podstawie informacji przekazanych przez Klienta.
7. Sprzedawca ustosunkuje się do reklamacji niezwłocznie, nie później niż w terminie 14 dni od dnia jej otrzymania. Jeżeli Sprzedawca nie udzieli odpowiedzi w tym terminie, uważa się, że uznał reklamację za uzasadnioną, o ile taki skutek wynika z powszechnie obowiązujących przepisów prawa.
8. Jeżeli reklamacja dotyczy Raportu papierowego i zachodzi potrzeba odesłania Produktu, należy go wysłać na adres: Fundacja Instytut Studiów Wschodnich, ul. Solec 85, 00-382 Warszawa, chyba że Sprzedawca wskaże inny adres lub inny sposób przekazania Produktu w związku z obsługą reklamacji.
9. Koszty doprowadzenia Raportu papierowego do zgodności z Umową Sprzedaży, w tym koszty przesyłki, przewozu, robocizny i materiałów, ponosi Sprzedawca w zakresie wymaganym przepisami ustawy o prawach konsumenta.
10. W przypadku reklamacji dotyczącej Treści cyfrowych, Usług cyfrowych albo Webinarów Sprzedawca w pierwszej kolejności może zweryfikować status Zamówienia, status płatności, prawidłowość adresu e-mail, log wysyłki wiadomości, aktywność linku oraz spełnienie wymagań technicznych przez Klienta. Jeżeli reklamacja jest zasadna, Sprzedawca ponownie wyśle wiadomość, udostępni prawidłowy link, zapewni alternatywny dostęp albo zastosuje inne uprawnienie przewidziane przepisami prawa.
11. Wobec Klientów niebędących Konsumentami ani Przedsiębiorcami na prawach konsumenta odpowiedzialność Sprzedawcy z tytułu rękojmi może zostać wyłączona albo ograniczona w zakresie dopuszczalnym przez przepisy Kodeksu cywilnego, o ile takie wyłączenie lub ograniczenie wynika z Regulaminu lub odrębnej umowy.
Podstawa prawna: art. 7a, art. 43a-43g oraz art. 43h-43q ustawy o prawach konsumenta; art. 556-576 Kodeksu cywilnego w relacjach, w których przepisy o rękojmi mają zastosowanie.
§ 11. Dane osobowe w Sklepie internetowym
1. Administratorem danych osobowych Klientów zbieranych za pośrednictwem Sklepu jest Sprzedawca.
2. Dane osobowe Klientów są przetwarzane w szczególności w celu:
a) zawarcia i wykonania Umowy Sprzedaży;
b) obsługi Zamówienia, płatności, dostawy Raportu papierowego, dostarczenia Treści cyfrowych oraz przekazania linków i informacji dotyczących Webinarów;
c) obsługi reklamacji, odstąpienia od umowy, zwrotów i korespondencji z Klientem;
d) wystawienia dokumentów księgowych, jeżeli są wymagane;
e) realizacji celów marketingowych, jeżeli Klient wyraził odrębną zgodę.
3. Odbiorcami danych osobowych Klientów mogą być w szczególności:
a) przewoźnicy, operatorzy pocztowi, operatorzy paczkomatów i pośrednicy realizujący dostawy;
b) Podwykonawcy logistyczni oraz osoby lub podmioty współpracujące ze Sprzedawcą przy przygotowaniu Produktów do wysyłki, pakowaniu, nadawaniu przesyłek, obsłudze zwrotów i obsłudze reklamacji - wyłącznie w zakresie niezbędnym do wykonania tych czynności;
c) operatorzy płatności elektronicznych i kart płatniczych;
d) dostawcy usług hostingowych, poczty elektronicznej, systemów informatycznych, narzędzi do obsługi Sklepu oraz narzędzi do obsługi Webinarów lub dostarczania Treści cyfrowych;
e) podmioty świadczące na rzecz Sprzedawcy usługi księgowe, prawne, doradcze lub techniczne.
4. Jeżeli Podwykonawca logistyczny albo inny podmiot przetwarza dane osobowe w imieniu Sprzedawcy i na jego polecenie, Sprzedawca zawiera z takim podmiotem umowę powierzenia przetwarzania danych osobowych albo stosuje inne wymagane prawem instrumenty, zgodnie z art. 28 RODO.
5. Podanie danych osobowych jest dobrowolne, jednak niepodanie danych niezbędnych do zawarcia lub wykonania Umowy Sprzedaży może uniemożliwić złożenie Zamówienia, dostawę Raportu papierowego, dostarczenie Treści cyfrowych albo przekazanie dostępu do Webinaru.
6. Klient ma prawo dostępu do swoich danych, ich sprostowania, usunięcia, ograniczenia przetwarzania, przenoszenia danych, wniesienia sprzeciwu oraz wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych, w zakresie i na zasadach określonych w RODO.
7. Szczegółowe informacje o przetwarzaniu danych osobowych znajdują się w Polityce prywatności Sklepu internetowego.
Podstawa prawna: art. 6, art. 13, art. 15-22 i art. 28 RODO.
§ 13. Postanowienia końcowe
1. Umowy zawierane za pośrednictwem Sklepu są zawierane w języku polskim.
2. Prawem właściwym dla Umów Sprzedaży zawieranych za pośrednictwem Sklepu jest prawo polskie. Wybór prawa polskiego nie pozbawia Konsumenta ochrony przyznanej mu na podstawie przepisów, których nie można wyłączyć w drodze umowy na mocy prawa, które byłoby właściwe w braku wyboru prawa.
3. Sprzedawca może zmienić Regulamin z ważnych przyczyn, w szczególności w przypadku zmiany przepisów prawa, zmiany sposobów płatności, zmiany sposobów dostawy, zmiany funkcjonalności Sklepu, zmiany sposobu dostarczania Treści cyfrowych lub Webinarów albo zmiany danych Sprzedawcy, w zakresie, w jakim zmiany te wpływają na postanowienia Regulaminu.
4. Do Umów Sprzedaży zawartych przed wejściem w życie zmiany Regulaminu stosuje się Regulamin w brzmieniu obowiązującym w chwili zawarcia danej Umowy Sprzedaży, chyba że przepisy prawa bezwzględnie obowiązującego stanowią inaczej.
5. W sprawach nieuregulowanych Regulaminem zastosowanie mają powszechnie obowiązujące przepisy prawa polskiego, w szczególności Kodeks cywilny, ustawa o prawach konsumenta, ustawa o świadczeniu usług drogą elektroniczną, RODO oraz ustawa o pozasądowym rozwiązywaniu sporów konsumenckich.
6. Postanowienia Regulaminu nie mają na celu wyłączenia ani ograniczenia jakichkolwiek praw Konsumenta lub Przedsiębiorcy na prawach konsumenta, które przysługują im na podstawie bezwzględnie obowiązujących przepisów prawa. W razie sprzeczności postanowień Regulaminu z takimi przepisami pierwszeństwo mają przepisy prawa.

TERMS AND CONDITIONS OF THE STORE OF SALE OF THE WARSAW SCHOOL OF ECONOMICS REPORT AND THE ECONOMIC FORUM
§ 1. Preliminary provisions
1. The online store is available at the Internet address https://raportsghforum.pl.
2. These Terms and Conditions are addressed to Consumers, Entrepreneurs and Entrepreneurs with consumer rights using the Store and specify the rules of using the Store, placing Orders, concluding and performing Distance Sales Agreements, delivering Products, providing digital content and digital services, withdrawing from the contract, returns and complaints.
3. The Terms and Conditions also constitute the terms and conditions for the provision of services by electronic means within the meaning of Article 8 of the Act of 18 July 2002 on the provision of services by electronic means in the scope of services provided through the Store, in particular enabling the viewing of the assortment, placing Orders, maintaining the Account and electronic communication.
4. The Terms and Conditions take into account, in particular, the provisions of: the Act of 30 May 2014 on Consumer Rights, the Civil Code, the Act of 18 July 2002 on the Provision of Services by Electronic Means, Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR), the Act of 23 September 2016 on out-of-court dispute resolution for consumer disputes and Regulation (EU) 2024/3228 of the European Parliament and of the Council repealing Regulation (EU) No 524/2013 on the ODR platform.
Legal basis: Article 8(1) of the Act on the Provision of Services by Electronic Means; Article 12, Article 17, Article 21, Articles 27-38 and Articles 43a-43q of the Consumer Rights Act; Article 548 § 3 of the Civil Code; Article 28 of the GDPR; Regulation (EU) 2024/3228.
§ 2. Definitions
1. Consumer – a natural person concluding an agreement with the Seller through the Store, the subject of which is not directly related to their business or professional activity.
2. Entrepreneur with consumer rights – a natural person concluding an agreement with the Seller directly related to his business activity, when the content of this agreement shows that it does not have a professional character for that person, resulting in particular from the subject of his business activity disclosed in the CEIDG. The provisions of the Terms and Conditions concerning the Consumer shall apply to such a person to the extent resulting from the generally applicable provisions of law.
3. Seller - Institute of Eastern Studies Foundation with its registered office in Warsaw, 85 Solec Street, 00-382 Warsaw, NIP 521-10-01-909, entered into the Register of Associations, Other Social and Professional Organizations, Foundations and Independent Public Health Care Institutions kept by the District Court for m.st Warsaw in Warsaw, XII Commercial Division of the National Court Register, under KRS number 0000010303.
4. Customer – any entity making purchases through the Store or using the Store.
5. Entrepreneur – a natural person, a legal person or an organizational unit that is not a legal person, which is granted legal capacity by law, performing business or professional activity in its own name and using the Store.
6. Shop – an online store run by the Seller at https://raportsghforum.pl.
7. Terms and Conditions – these Terms and Conditions of the Store.
8. Order – a declaration of intent of the Client submitted using the Order Form and aimed directly at concluding the Sales Agreement of the Product or Products with the Seller.
9. Account – the Client's account in the Store, in which the data provided by the Client and information about the Orders placed are collected, if the Store provides for the functionality of the Account.
10. Order Form – an interactive form available in the Shop enabling the placing of an Order, in particular by adding Products to the Basket, providing the data necessary to perform the contract and choosing the method of delivery and payment.
11. Shopping cart – an element of the Store's software in which the Products selected by the Customer, price, delivery costs and Order data that can be modified before placing it are visible.
12. Product – goods, digital content, digital services or other services available in the Store, which are the subject of the Sales Agreement between the Client and the Seller.
13. Paper Report - A product that is a movable item in the form of a printed report, delivered to the Client by courier, to a parcel locker or by another method indicated in the Store.
14. Pre-Release Product - A Product offered in the Store before the date of its official premiere, presentation, publication or availability, in particular a Paper Report offered for pre-sale before its official presentation. The Pre-Order Product is shipped or made available within the time specified in the Product description, in the Shopping Cart, or in the Order summary prior to the Order being placed.
15. Digital content – data produced and delivered in digital form, in particular a PDF report, webinar recording, presentation, file, download link or other electronic material that is not provided on a tangible medium.
16. Digital Service – a service that allows the Client to produce, process, store or access data in digital form or share data in digital form, if it is offered by the Seller within the Store.
17. Webinar – a service provided electronically, consisting in providing the Client with participation in a meeting, training, online broadcast or access to a recording, in accordance with the description of the Product.
18. Sales Agreement – an agreement concluded or concluded between the Client and the Seller through the Store. Depending on the type of Product, the Sales Agreement shall also be understood as a contract for the provision of digital content, a contract for the provision of a digital service or a contract for the provision of services.
19. Logistics Subcontractor – a person or an external entity acting on behalf of the Seller, performing technical activities related to the preparation of the Paper Report for shipment, packaging, sending shipments or handling returns. The use of a Logistics Subcontractor does not limit the Seller's liability to the Customer.
20. Working day - the day from Monday to Friday, excluding public holidays in Poland.
21. Durable medium – a material or tool that allows the Client to store information addressed personally to the Client in a way that allows access to the information in the future for a period of time appropriate to the purposes for which the information is used and allows the storage information to be reproduced in an unaltered form; an example of a durable medium is an e-mail message.
Legal basis: Article 2(4), Article 2(5a) and Article 2(5b) of the Consumer Rights Act; Article 43h of the Act on Consumer Rights; Article 385(5) of the Civil Code and provisions extending consumer protection to specific entrepreneurs-natural persons.
§ 3. Contact with the Store

3. The Client may communicate with the Seller using the e-mail address or correspondence address indicated in this paragraph.
4. The Seller may contact the Client at the e-mail address provided by the Client when placing the Order, in particular to confirm the Order, deliver the Digital Content, provide a link to the Webinar, handle complaints, handle withdrawal from the contract or process a return.
§ 4. Technical requirements
1. In order to use the Store, including browsing the assortment and placing Orders, the following are necessary:
a) an end device with access to the Internet;
b) an up-to-date web browser that supports standard websites, e.g. Chrome, Firefox, Edge, Safari or Opera;
c) an active email account;
d) enabled cookies to the extent necessary for the operation of the Shop;
e) the ability to read e-mails and open attachments or links sent by the Seller.
2. To use the Digital Content or Webinars, you may additionally require:
a) a program that allows you to read PDF files, if the Product includes materials in PDF format;
b) the web browser or application indicated in the Product description or in the access email;
c) a stable Internet connection enabling participation in the Webinar or downloading materials;
d) a device capable of sound and video reproduction, if the Product includes a recording or audiovisual transmission.
3. The Seller shall inform the Client in the Product description or prior to the conclusion of the Sales Agreement about the essential functionalities, compatibility and interoperability of the Digital Content, Digital Services or Webinars that the Seller knows or should be aware of.
4. The Client should provide a valid e-mail address and ensure the possibility of receiving messages from the Seller, including checking the SPAM folder, offers, other or similar folder, if the message with the Order confirmation, Digital Content or link to the Webinar has not reached the main inbox.
Legal basis: Article 8(3) of the Act on the Provision of Services by Electronic Means; Article 12(1)(19-20) of the Consumer Rights Act.
§ 5. General information
1. The Seller sells Products through the Store, in particular the Paper Report, Digital Content and Webinars.
2. The Seller may offer Pre-Order Products in the Store, including a Pre-Order Paper Report. In such a case, information about the pre-release nature of the Product, the date of release, presentation, publication or making available, and the expected date of shipment or delivery of the Product is indicated in the description of the Product or in the course of placing an Order before concluding the Sales Agreement.
3. Browsing the Store's assortment does not require creating an Account. Placing Orders is possible after providing the data necessary for the execution of the Order, in particular identification data, contact details, e-mail address, and in the case of a paper Report, also address data necessary for delivery.
4. The prices given in the Store are expressed in Polish zlotys and constitute the total prices due from the Client, including taxes, if they are due in accordance with the regulations. Prior to placing an Order, the Client is informed of the total amount to be paid, including the price of the Product and the costs of delivery, payment or other costs, if any.
5. The final amount to be paid consists of the price of the Product and the cost of delivery of the Paper Report or other costs indicated to the Client before placing the Order. If the Product is delivered electronically only, the cost of physical delivery is not charged, unless expressly indicated otherwise.
6. If the nature of the Product does not allow, reasonably judging, for an earlier calculation of the price or additional costs, the Seller shall inform the Client before placing the Order about the method of calculating the price or costs.
7. The Seller does not apply to the Consumer the default options that result in additional payments. Additional payments require the Customer's express consent prior to placing an Order.
8. The Seller shall not be liable to the fullest extent permitted by law for any disruptions in the functioning of the Store caused by force majeure, unauthorized actions of third parties or incompatibility of the Customer's technical infrastructure with the technical requirements indicated in the Terms and Conditions. This provision does not limit the statutory rights of the Consumer and the Entrepreneur on the rights of the consumer.
Legal basis: Article 12(1)(5), (6), (10), (19) and (20), Article 17 and Article 18 of the Consumer Rights Act.
§ 6. Order Rules
1. In order to place an Order, you should:
a) select the Product that is the subject of the Order and add it to the Shopping Cart;
b) fill in the Order Form, providing the data necessary for the performance of the Sales Agreement, in particular the e-mail address, payment details, invoice data, if an invoice is required, and the delivery address in the case of a Paper Report;
c) select one of the available methods of delivery of the Paper Report if the Order includes a Product requiring physical delivery;
d) read the summary of the Order, including the total price, delivery costs and terms of delivery of the Products, and in the case of a pre-release Product also with information that the Product is offered in pre-order, will not be sent or made available before the indicated date of premiere, presentation, publication or making available, and will be sent or made available within the date indicated in the description of the Product, Shopping cart or Order summary;
e) in the case of Digital Content or Webinars to be delivered or commenced before the expiry of the withdrawal period, submit separate legally required statements and consents referred to in § 9 of the Terms and Conditions;
f) click on the "Order and pay" button or any other equivalent button clearly indicating that the Order entails an obligation to pay;
g) choose one of the available payment methods and pay for the Order.
2. Until clicking the "Order and pay" button, the Client may modify the Order data and selected Products in the Basket.
3. Clicking the "Order and pay" button means that the Client places an Order with the obligation to pay.
Legal basis: Article 17(2)-(4) of the Consumer Rights Act.
§ 7. Delivery and payment methods offered
1. The Client may use the following methods of delivery of the Paper Report, if they are currently available in the Store:
a) courier delivery and InPost Parcel Lockers;
b) DPD courier delivery;
d) another delivery method clearly indicated in the Store before placing the Order – if any.
2. Digital content, download links, electronic materials, access links to Webinars or organizational information regarding Webinars are delivered to the e-mail address provided by the Customer in the Order, unless the description of the Product expressly provides for another method of delivery.
3. Detailed information about the available delivery methods, delivery costs, expected date of shipment or delivery of the Product is indicated in the Store no later than before placing the Order. In the case of Pre-Release Products, the shipping or delivery date may be after the date of release, presentation, publication or availability of the Product, of which the Customer is informed prior to placing the Order.
4. The Seller may use the services of a Logistics Subcontractor to prepare a Paper Report for shipment, packing, sending shipments and handling returns. The use of a Logistics Subcontractor does not limit the Seller's liability towards the Client for the proper performance of the Sales Agreement, including the release of the Product, delivery of the Product, handling of complaints and handling withdrawal from the contract.
5. The entity providing online payment services is Przelewy24, in particular in the field of electronic payments, electronic transfers, BLIK and payment card payments: Visa, Visa Electron, MasterCard, MasterCard Electronic and Maestro, if a given payment method is available in the Store at the time of placing the Order.
6. Detailed information on accepted payment methods is available on the Store's website and visible to the Client before placing an Order.
Legal basis: Article 12(1)(5), (9) and (10) of the Consumer Rights Act; Article 548 § 3 of the Civil Code.
§ 8. Execution of the sales contract
1. The Sales Agreement between the Client and the Seller is concluded after placing an Order using the Order Form, in accordance with § 6 of the Terms and Conditions, and after the Seller confirms the acceptance of the Order.
2. After placing the Order, the Seller shall immediately confirm the receipt of the Order and its acceptance for execution by sending the Client an e-mail to the address provided when placing the Order. The e-mail message is a confirmation of the conclusion of the Sales Agreement on a durable medium.
3. The confirmation referred to in paragraph 2 shall include at least information about the Seller, the Product, the price, delivery costs, the method of payment, the method and date of delivery of the Product, and in the case of a pre-release Product, also information about the pre-release nature of the Product and the date of its dispatch or availability, instructions on the right to withdraw from the contract or its absence, the complaint procedure and the content of the Terms and Conditions or access to their content in the form possible to be recorded.
4. In the case of Digital Content or Webinars delivered or commenced before the expiry of the withdrawal period, the Seller shall also confirm to the Client on a durable medium the Client's consent to start providing the Digital Content or performing the service before the expiry of the withdrawal period and the confirmation of the Client's acknowledgment of the effects of this consent.
5. In the case of electronic payments or payment by payment card, the Client is obliged to make the payment within 2 calendar days from the date of placing the Order, unless the description of the Product or the message of the payment operator indicates a different date. Failure to pay within this period may result in the cancellation of the Order.
6. The paper report shall be sent within the time specified in the description of the Product or in the summary of the Order, and if no such deadline is indicated - no later than within 30 days from the date of conclusion of the Sales Agreement, subject to paragraph 7.
7. Paper reports can be prepared and broadcast in batches. If the Seller uses batch shipping, information about the shipping date or rules for shipping in batches is provided to the Customer in the description of the Product or during the Order process, before clicking the "Order and pay" button.
8. In the case of Pre-Release Products, including the Paper Report offered in pre-order, the date of shipment or delivery of the Product may be later than 30 days from the date of conclusion of the Sales Agreement, if such a later date has been expressly indicated to the Customer before placing the Order, in particular in the Product description, Shopping Cart, Order summary or Order confirmation.
9. The paper report, which will be officially unveiled on September 8, 2026, is a Pre-Release Product. This paper Report will be sent no earlier than September 8, 2026.
10. The paper report referred to in §2 section 13 will be sent for dispatch within 5 working days from 8 September 2026, unless a different date is indicated in the description of the Product or the summary of the Order. Orders may be executed in batches, in accordance with the order in which Orders are placed and paid or in accordance with other rules indicated to the Client before placing the Order.
8. The Paper Report is delivered only in Polish territory, unless otherwise expressly indicated in the Product description or in the Store.
9. The risk of accidental loss or damage to the Paper Report shall pass to the Consumer at the moment of its issuance to the Consumer or to a third party indicated by the Consumer other than the carrier. If the Consumer has chosen a carrier that the Seller did not offer in the Store, the danger passes to the Consumer at the moment of handing over the Product to that carrier.
10. Digital content and electronic materials are provided by sending an e-mail containing a file, download link, access manual or other information enabling the use of the Product. The date of delivery of the Digital Content is indicated in the description of the Product, the summary of the Order or an e-mail, and in the absence of such information, the Digital Content is delivered immediately after obtaining a positive payment authorization, if the Client has agreed to its delivery before the expiry of the deadline for withdrawal from the agreement.
11. A link to the live Webinar or organizational information regarding the Webinar is sent to the Client's e-mail address within the time specified in the Product description or in the message confirming the Order, no later than before the start of the Webinar, unless otherwise stated in the Product description.
12. If the Order includes both the Paper Report and the Digital Content or the Webinar, the individual services may be performed independently of each other, respectively by the physical delivery of the Paper Report and the sending of materials or links to the e-mail address.
13. In the event that you do not receive an email with the Digital Content, download link or link to the Webinar, Customer should check the SPAM folder, offers, other or similar folder and then contact the Seller. Vendor will verify the status of the Order and, if reasonable, resend the message or provide other agreed means of access.
Legal basis: Article 21 of the Consumer Rights Act; Article 543(1) and Article 548 § 3 of the Civil Code; Articles 43k-43m of the Act on Consumer Rights in the Field of Provision of Digital Content or Digital Services.
§ 9. Right of withdrawal and returns
1. The Consumer and the Entrepreneur with the rights of a consumer may, as a rule, withdraw from the Distance Sales Agreement within 14 days without giving a reason, subject to the exceptions indicated in the Terms and Conditions and the provisions of law.
2. The period for withdrawal from the contract shall begin:
a) for the Paper Report – from the Consumer taking possession of the Paper Report by the Consumer or a third party other than the carrier indicated by the Consumer;
b) for a Contract covering many items delivered separately, in batches or in parts – from taking possession of the last item, lot or part;
c) for the Agreement consisting in the regular delivery of things for a definite period of time - from taking possession of the first item;
d) for contracts for the provision of services, including Webinars, and for contracts for the provision of Digital Content or Digital Services not provided on a tangible medium - from the date of conclusion of the agreement.
3. In the case of a Paper Report offered in pre-sale or as a Pre-Release Product, the period for withdrawal from the agreement is calculated in accordance with section 2(a), i.e. from the date of taking possession of the Paper Report by the Consumer or a third party other than the carrier indicated by the Consumer, regardless of the date of placing the Order or the date of payment.
4. The Consumer may withdraw from the Sales Agreement by submitting a statement of withdrawal from the agreement to the Seller. To meet the deadline, it is enough to send the statement before its expiry.
5. The statement may be sent by traditional mail to the Seller's address or by e-mail to the e-mail address indicated in § 3 of the Terms and Conditions. The Consumer may use the statutory template of the withdrawal form, constituting Appendix No. 1 to the Terms and Conditions, but it is not mandatory, or use the withdrawal form available directly on the website.
6. In the event of receiving a statement of withdrawal by electronic means, the Seller shall immediately confirm to the Consumer the receipt of the statement to the Consumer's e-mail address.
7. In the event of withdrawal from the Sales Agreement, the agreement shall be deemed not to have been concluded, and the Seller shall reimburse the Consumer for all payments received from the Consumer, including the costs of delivering the Paper Report to the Consumer, with the exception of additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest usual method of delivery offered by the Seller.
8. The Consumer may submit a statement of withdrawal from the agreement regarding the Paper Report offered in pre-sale also before its dispatch. In such a case, the Seller shall refund the payments in accordance with the Terms and Conditions and the provisions of law, without waiting for the return of the Product that has not yet been sent to the Consumer.
9. The payment shall be refunded immediately, no later than within 14 days from the date of receipt by the Seller of the statement of withdrawal from the contract, using the same method of payment used by the Consumer, unless the Consumer has expressly agreed to another method of reimbursement that does not entail any costs for the Consumer.
10. If the Order included a Paper Report, the Seller may withhold the refund of the payment until the Paper Report is received back or until proof of its return is provided to the Seller, whichever occurs first.
11. The Consumer should send the Paper Report to the following address: Institute of Eastern Studies Foundation, 85 Solec Street, 00-382 Warsaw, immediately, no later than within 14 days from the date on which the Consumer informed the Seller of the withdrawal from the agreement. The deadline is met if the Consumer sends the Paper Report back before the expiry of the 14-day period.
12. The Consumer bears the direct costs of returning the Paper Report, unless the Seller agreed to bear them or did not inform the Consumer before concluding the agreement about the need to incur these costs.
13. The Consumer is responsible for the decrease in the value of the Paper Report resulting from its use in a manner other than necessary to determine the nature, characteristics and functioning of the Product.
14. If the Consumer has requested the commencement of the provision of the service, including the Webinar, before the expiry of the period for withdrawal from the contract, and then exercises the right of withdrawal before the full performance of the service, the Consumer is obliged to pay for the services provided until the moment of withdrawal from the contract in proportion to the scope of the performance performed, provided that such an obligation results from the provisions of law and the Seller has correctly informed the Consumer about the consequences of the commencement of the service.
15. The Consumer is not entitled to withdraw from the contract, in particular with regard to the contract:
a) for the provision of services for which the Consumer is obliged to pay the price, if the Seller has fully performed the service with the express and prior consent of the Consumer, who has been informed before the commencement of the service that after the performance by the Seller he will lose the right to withdraw from the contract, and has acknowledged this;
b) for the provision of Digital Content not delivered on a tangible medium, for which the Consumer is obliged to pay the price, if the Seller has commenced the service with the express and prior consent of the Consumer, the Consumer has been informed before the commencement of the performance that after the commencement of the service he will lose the right to withdraw from the contract, he has acknowledged this, and the Seller has provided the Consumer with a confirmation of the conclusion of the contract and a confirmation of the consent granted on a durable medium;
c) in which the subject of the service is a non-prefabricated item, manufactured according to the Consumer's specifications or serving to satisfy his individualized needs;
d) in which the subject of the supply are things which, after delivery, due to their nature, are inseparably connected with other things;
e) in other cases indicated in Article 38 of the Consumer Rights Act, if applicable to a specific Product.
16. In the case of Digital Content or Webinars sent to the e-mail address, the Seller shall apply separate consents and confirmations in the Order Form if the delivery of the Digital Content or the commencement of the provision of the service is to take place before the expiry of 14 days from the conclusion of the agreement.
17. The mere indication in the Terms and Conditions that a given Product is digital does not automatically result in the loss of the right to withdraw from the agreement. The loss of the right of withdrawal in relation to Digital Content or services provided before the expiry of the withdrawal period requires the fulfilment of the conditions set out in the Consumer Rights Act.
Legal basis: Articles 27-35 and 38 of the Consumer Rights Act; Article 21 of the Act on Consumer Rights in the scope of confirming consent on a durable medium.
§ 10. Complaints, non-conformity of goods with the contract and warranty
1. The Seller is obliged to deliver the Product in accordance with the Sales Agreement.
2. Towards the Consumer and the Entrepreneur with consumer rights, the Seller's liability for the Paper Report is determined by the provisions of the Act on Consumer Rights concerning the non-conformity of the goods with the contract, in particular Articles 43a-43g of this Act.
3. The Seller's liability for Digital Content, Digital Services and Webinars towards the Consumer and the Entrepreneur with consumer rights is defined by the provisions of the Act on Consumer Rights concerning Digital Content and Digital Services, in particular Articles 43h-43q of this Act, taking into account the type of a given service.
4. The complaint may concern, in particular:
a) damage, incompleteness, delay, non-delivery or non-conformity of the Paper Report with the description of the Product;
b) you do not receive an email with the Digital Content, a download link, a link to the Webinar or an access manual;
c) an inactive, erroneous or non-working link;
d) a file that cannot be opened despite meeting the technical requirements;
e) lack of access to the Webinar despite correctly paying for the Order and meeting the technical requirements;
f) provide materials other than those indicated in the description of the Product;
g) any other non-conformity of the Product with the Sales Agreement.
5. A complaint may be submitted in writing to the Seller's address or by e-mail to the e-mail address indicated in § 3 of the Terms and Conditions.
6. It is recommended that the complaint contains the Client's data, the Order number, a description of the non-conformity, the date of its discovery, the Client's request and contact details enabling the response to be provided. The absence of these elements does not render the complaint ineffective, if it is possible to consider it on the basis of the information provided by the Client.
7. The Seller shall respond to the complaint immediately, no later than within 14 days from the date of its receipt. If the Seller fails to respond within this period, it is considered that the complaint is justified, provided that such an effect results from generally applicable provisions of law.
8. If the complaint concerns a paper Report and there is a need to send the Product back, it should be sent to the following address: Institute of Eastern Studies Foundation, 85 Solec Street, 00-382 Warsaw, unless the Seller indicates a different address or other method of handing over the Product in connection with the handling of the complaint.
9. The costs of bringing the Paper Report into compliance with the Sales Agreement, including the costs of shipping, transport, labour and materials, shall be borne by the Seller to the extent required by the provisions of the Consumer Rights Act.
10. In the event of a complaint regarding Digital Content, Digital Services or Webinars, the Seller may first verify the status of the Order, the status of the payment, the correctness of the e-mail address, the log of sending messages, the activity of the link and the fulfilment of technical requirements by the Client. If the complaint is justified, the Seller will resend the message, provide a valid link, provide alternative access or apply another right provided for by law.
11. Towards Clients who are not Consumers or Entrepreneurs with consumer rights, the Seller's liability under the warranty may be excluded or limited to the extent permitted by the provisions of the Civil Code, if such exclusion or limitation results from the Terms and Conditions or a separate agreement.
Legal basis: Article 7a, Article 43a-43g and Article 43h-43q of the Consumer Rights Act; Articles 556-576 of the Civil Code in relations in which the provisions on warranty apply.
§ 11. Personal data in the Online Store
1. The Seller is the administrator of the Customers' personal data collected through the Store.
2. The personal data of the Clients are processed in particular for the purpose of:
a) concluding and performing the Sales Agreement;
b) handling the Order, payment, delivery of the Paper Report, delivery of the Digital Content and providing links and information regarding the Webinars;
c) handling complaints, withdrawal from the contract, returns and correspondence with the Client;
d) issuing accounting documents, if required;
e) the implementation of marketing purposes, if the Client has given a separate consent.
3. The recipients of the Clients' personal data may be in particular:
a) carriers, postal operators, parcel locker operators and intermediaries carrying out deliveries;
b) Logistics subcontractors and persons or entities cooperating with the Seller in preparing the Products for shipment, packaging, sending shipments, handling returns and handling complaints - only to the extent necessary to perform these activities;
(c) electronic payment and payment card operators;
d) providers of hosting services, e-mail, IT systems, tools for operating the Store, and tools for handling Webinars or providing Digital Content;
e) entities providing accounting, legal, advisory or technical services to the Seller.
4. If the Logistics Subcontractor or other entity processes personal data on behalf of the Seller and at its instruction, the Seller shall enter into an agreement with such entity to entrust the processing of personal data or use other instruments required by law, in accordance with Article 28 of the GDPR.
5. Providing personal data is voluntary, however, failure to provide the data necessary to conclude or perform the Sales Agreement may make it impossible to place an Order, deliver a Paper Report, deliver Digital Content or provide access to the Webinar.
6. The Client has the right to access their data, rectify them, delete them, limit processing, transfer data, object and lodge a complaint with the President of the Office for Personal Data Protection, to the extent and on the terms set out in the GDPR.
7. Detailed information on the processing of personal data can be found in the Privacy Policy of the Online Store.
Legal basis: Article 6, Article 13, Article 15-22 and Article 28 of the GDPR.
§ 13. Final provisions
1. Agreements concluded through the Store are concluded in Polish.
2. The law applicable to Sales Agreements concluded through the Store is Polish law. The choice of Polish law does not deprive the Consumer of the protection granted to him on the basis of provisions that cannot be excluded by way of a contract under the law that would be appropriate in the absence of a choice of law.
3. The Seller may amend the Terms and Conditions for important reasons, in particular in the event of a change in the law, a change in payment methods, a change in delivery methods, a change in the functionality of the Store, a change in the method of delivery of Digital Content or Webinars or a change in the Seller's data, to the extent that these changes affect the provisions of the Terms and Conditions.
4. The Terms and Conditions in force at the time of concluding a given Sales Agreement shall apply to Sales Agreements concluded prior to the entry into force of the amendment to the Terms and Conditions, unless the provisions of mandatory law provide otherwise.
5. In matters not regulated by the Terms and Conditions, the generally applicable provisions of Polish law shall apply, in particular the Civil Code, the Act on Consumer Rights, the Act on the Provision of Services by Electronic Means, the GDPR and the Act on Out-of-Court Settlement of Consumer Disputes.
6. The provisions of the Terms and Conditions are not intended to exclude or limit any rights of the Consumer or the Entrepreneur on the rights of the Consumer that they are entitled to on the basis of mandatory provisions of law. In the event of a conflict between the provisions of the Terms and Conditions and such provisions, the provisions of law shall prevail.
